The Humboldt County Board of Adjustments will once again meet to hear a petition by Cole Anderson regarding an application for a special exception use permit.
Anderson is the owner of a defunct quarry in Rutland. The quarry had ceased being operational sometime in the 1960’s when the owners of the quarry found they were unable to pump water out of the hole fast enough to keep up with operations.
Since the closing of the quarry, it has been privately owned and used as residential property.
Anderson states with new equipment, he will be able to once again mine the site to remove limestone.
The site had been rezoned as an agricultural site, thus requiring the special exception use permit.
The petition was heard by the previous Board of Adjustment in the later part of 2023 and was denied. It was later discovered that the rules regarding Board of Adjustment members had changed in 2020 and the board did not actually constitute a quorum, causing the decision to be nullified.
This discovery has left both the County and Anderson in a holding pattern while a new Board of Adjustment was appointed and trained.
